A woman claims Pittsburgh Steelers quarterback Ben Roethlisberger lured her into a hotel room, then sexually assaulted her, according to a new lawsuit.

Andrea McNulty claims in her civil lawsuit filed in Washoe County, Nevada, this year's Super Bowl winner asked her to come to his hotel room in July, 2008 -- and then forced her to have sex with him.

McNulty -- an employee at the Harrah's Hotel in Lake Tahoe -- is suing for sexual assault and battery, false imprisonment and infliction of emotional distress.

Ben denies all of McNulty's allegations. Roethlisberger's lawyer told ProFootballTalk.com, "The timing of the lawsuit and the absence of a criminal complaint and a criminal investigation are the most compelling evidence of the absence of any criminal conduct."

I agree with Ben's lawyer

Why didn’t she go to the police with this?? Sounds fishy to me. Guys like Ben, Romo, Brady, etc don’t have to force any girl to have sex with them, they can get any hot chick they want, any time they want, any where they want.

It is not fishy at all it was in 2008

There is a reason the statute of limitations is extended on sexual assault cases, because in many many cases the victim for various reasons doesn’t want to immediately file charges but later changes her mind.

Also it doesn’t seem like Ben is being specifically targeted, because there are 8 other defendants.

It's very fishy

Regardless of what you think about the Steelers, this lady’s story is full of holes. Also, this is a civil case, so the statue of limitations has nothing to do with it. The Reno police have now stated that they have no intention of pursuing a criminal case against Ben, so clearly something isn’t jiving.

there is all sorts of reasons why people commit rape, not just because someone can’t “get any hot chick they want.”

The allegations are that his actions were tortious

If her allegations are true, a civil court will award damages. She has no ability to prove criminal conduct in a civil proceeding, and the court has no jurisdiction to find that his actions were criminal.

The allegations were both tortious and criminal and what Ben’s atty is saying that if the allegations had any merit to them, she would have went to the police a long time ago and not waited a year just to sue civilly and I agree with him 100%.

Totally bogus allegations and I don’t even like Ben.

Everyone here knows I don’t think much of Roethlisberger, but this chick’s actions don’t make sense.

A rape victim isn’t going to wait a year and then file a civil suit without going to the police first, doesn’t make sense at all.

Ben might be a prick, but he doesn’t have to force himself on women, I know that much for sure.

I said they don’t file a civil lawsuit before filing a criminal complaint, I guarantee that doesn’t happen all the time.

BTW, I would hardly call filing a lawsuit seeking justice, I call that being litigious.

The allegations are framed within a lawsuit

The point of the lawsuit is to establish that his conduct was tortious. While that conduct may also be criminal, it is irrelevant. The allegations are contained in a civil lawsuit – the criminal law is of no relevance and the allegations do not need to establish criminal conduct or meet the criminal burden of proof.

While I agree these allegations sound bogus, victims of sexual assault don’t always come forward right away. It can really mess someone up. Many never do, and some wait. However, it seems to me like those who wait usually go to the police first.

which is what Ben’s lawyer was trying to say and which is correct. The fact she never went to the police makes the allegations seem very bogus to me.

Victims of sexual abuse aren’t looking for money, they’re looking for justice and punishment of their abuser and that only happens by having him charged criminally.

You don’t have to go through the legal procedures between civil and criminal law, learned all that in law school a long time ago.
