Michael Irvin Sued In Rape Charge; Gets Fired, Counter Sues

As brilliant as Michael Irvin was on the field, his off-the-field life has always been something of a mess. You can add to that mess as Irvin has been sued in civil court over an allegation of rape.

Here's the basics: Irvin's accuser says she was raped by Irvin and an unidentified male at the Seminole Hard Rock Hotel & Casino on July 5th, 2007. She reported the incident on July 20th, 2007 to the authorities, but by that time there was no forensic evidence. She also signed a "waiver of prosecution" which basically meant she wanted to put the incident behind her.

She filed the lawsuit Thursday, and her lawyers claim that settlement negotiations had taken place but broke down, and that the woman passed a polygraph test.

Now, Irvin is counter-suing to the tune of $100 million since he's been fired from his ESPN radio gig. ESPN says they had planned to cancel the show anyway, and did it today because of this incident. Irvin, for now, is still part of the NFL Network team covering the Super Bowl.

Other than that, I really have nothing more to say on the incident, I can't judge it from this far away. But it's now news, and Irvin is one of my favorite Cowboys, so it pains me to post about it.

Irvin at Superbowl

Dave – I met the Playmaker at the Superbowl in Houston just a few years back going opposite directions on an escalator at 4AM in one of the major hotels there- he was with his wife. As we passed, I signaled him to wait for me at the top of the escalator for an autograph and he did – and he spent a good ten minutes joking around and telling stories…a great guy. His wife even took a photo of us yucking it up. Obviously, this has little to do with this latest news, and everything I have heard from the guys at NFL network is that he is first class…and I think he is better than any of the stuffed shirts on BSPN anyway.

I actually didn’t think Mike was bad on the radio. I was pleasantly surprised. But I will really miss Kevin Kiley and the Big Fella. They were great!

Nobody really knows, or ever will know what really happened except for those who were there.

But for the famous athlete there is an never-ending line of women that throw themselves at them, then change their minds about it later. I have trouble picturing Michael pinning some woman down and raping her. Why would he do that when it’s available to him everywhere he goes? The story stinks.

Mike’s show was great. He can be a tool sometimes but his personality combined with Kevin and Nate made for good radio. What? do you want more of collin cowherd?

Playmaker brings a freshness and spontaneity to radio that few do – he’s not reading off of a script that’s for sure. We need more like him.

Strongly doubt he did it

She decided to not press charges, seeing as how there was no evidence, and now 3 years later wants to sue the guy. Ridiculous. The fact that Mike is counter suing for 100 million alone tells me he more than likely didn’t do it.

Well you don't know the circumstances

the guilty party often counter sues so they get the response they are getting from you now. It is no sweat off their back.

Furthermore the statute of limitations for rape chargers is often longer than for other charges, precisely because the victim often decides to bring charges later in these types of cases. Partly because of societal pressures, like what you are doing now: blaming the alleged victim.

Given Irvin's history I would not be surprised at all

If these charges turn out to be true then his name needs to be taken down from the ring of honor.

And Irvin was hardly one of my favorite Cowboys, especially with his past.

He’s never had a history of assault, much less rape. I’d be surprise. If there was any truth in these charges.

I'm sure it wasn't premeditated and the intent probably wasn't malicious initially (if this supposed rape even happened)

but that is how most rapes happen. Guys are having “fun” and take it too far than the lady otherwise would like.

with 2 men, and if one does she only goes for three reasons. She’s looking for a good time or she’s a hooker or she’s setting them up. Her whole story smells like horsesh!t to me.

Where did I say anything about

a woman deserving to be raped? I don’t think this woman got raped. IMO she’s trying to blackmail Irvin. Look at how it all came down, If you want to think he’s guilty it’s your right, but to me it has scam written all over it. By your comments it seems you’re a Irvin hater and would think he’s guilty no matter what the evidence is.

I am with you on the part as if he did do it he should pay for it. But the funny part is she is just going after the money. If it is true then why not want him to go to jail? So he would not do it to someone else? She is making it look bad on herself for just going after the money. If she was really raped then she would do all she can to get him off the streets. Then after she does that then go after the money. Because how do you put a number on a rape? It is like saying you give me 10 mil and it will be okay? You said you do not like him and to tell you the truth he was not one of mine as well. But that still does not mean he did it.

In a civil case you cannot get jail time
If it is true then why not want him to go to jail?

Same reason why OJ didn’t get jail time for losing his civil case.

Because how do you put a number on a rape?

And how do you put a number on double murder? Apparently the Goldmans and the Browns were able to. This is done all the time.

She could have done it as a criminal case first. then go after the money. But no it was the money she cared about.

You are right about the Goldmans and Browns. But they went first for the criminal part before the civil case. They wanted him off the streets first then they went for the money.

It is not that easy

You have a dead body as evidence. After 3 years there is no way in hell that you could have a reasonable chance of winning a rape case. There is a much higher standard of proof for a criminal case. She would have been wasting her time and money, and her attorney probably told her it would be smarter to go with a civil trial in which she would stand a much better chance of winning.

The fact that she didn’t try to go through the criminal route first means nothing.

I have always hated the difference between the civil and criminal courts...

I am no OJ apologist, but if he was determined not guilty by our justice system, how can one turn around and make him pay millions of dollars to the victims? Its a big problem in America’s justice system in my opinion.

no its not because criminal cases have a much higher standard that needs to be met

as they should, because once you are found guilty your rights as an American is going to be severely limited. In civil cases the standard of proof is lower, as it should, because your rights as an American won’t essentially be limited in any significant way.

But I was talking more about the fact that people can be tried in criminal court and then civil court. For instance, OJ was found not guilty by the criminal courts, but then was found to be responsible for the deaths in civil court and forced to pay millions of dollars. To me, that is an illogical system. I fully understand that civil cases have a lower standard of proof and why, but I really dislike when people use both courts to create a pseudo-double jeopardy situation.

Like quincyyy pointed out, comparing criminal court with civil court is like comparing apples and oranges, two entirely different systems and rights all together.

Crime deals with wrongs against society and civil actions deal with wrongs against individuals or groups of individuals. They both have their own separate rules and procedures and for good reason as a person’s rights differ significantly regarding both.

Using your OJ example, you’re dealing with taking away his freedom versus taking away his money, really big difference, don’t you think?

Which in reality without witnesses or video tape meant no chance of any prosecution. So the police said no point in taking it any further THEN she signs that statement saying she wants no prosecution. THEN she waits for THREE YEARS to do anything else, choosing the week before the SB to go public. Sorry, but to me those facts say shakedown.

The 15 days wait.. Being raped by two men must be a pretty traumatic experience. I can see a person withdrawing from the world.

The no prosecution thing makes sense if there was no chance of evidence.

Waiting for the superbowl… It is not completely out of the question she would want to hurt him at his most vulnerable time. Now… waiting three years is funny I will grant you that, .

My point is… I hesitate to condemn the girl until all the facts are out. If it is true the girl has guts and this may very well ruin her life either way. (If the incident didn’t already do that.)

Let me first say that anyone can change if they want to. Now then I believe that Irvin still gets high, still runs with the dark side, and is a good person to talk with and to listen to. The woman may be after the money and she may not. I do think that based on Clemens behavior it is more fashionable to counter sue and look like you are innocent, than to just take some things and let the courts work them out. I will say that Clemens counter suit has not worked really well for him, certainly not as much as the truth would have. I beleived in Roger, as I would like to beleive in Irvin, but the fact is some of these guys lie and lie and lie. As far as the woman being a slut, well that is just crap. She might be a liar, a promiscuous person, a drug user, and many other things, but just because you screw someone does not make you a slut. I hope beyond hope that he is innocent and she is a liar, but I am getting too old to just beleive these players outright anymore, especially when there is a history there. DO you know who I am? That says a lot right there and that was Michael response to Police Officers and that really tells you where his mindset is. Again good luck to the guy, and for what’s its worth I don’t think he should have his name removed from the ring of honor, as that was something he was rewarded for based on his onfield accomplishment, not for being a decent person.

Reports were his show was cancelled prior to this coming out, not fired. who knows....

When someone files a lawsuit over 2 years later means its a BS way of some idiot trying to get money. She probably attempted to extort money from Irvin and when that failed she filed the lawsuit. I’m sure there was some type of involvement with this girl, but the allegations were made up. Another case of consensual sex later turning into a rape case to get money, i.e.., Ben Rothensburger.
